Terms of Service
These Terms govern your use of MorningText (the “Service”). By using the Service or starting a free trial, you agree to these Terms. If you do not agree, do not use the Service.
1. What MorningText is
MorningText is a private convenience and transcription service. On a schedule you configure, we place automated calls to a hotline number you provide, interpret the recording, and send you a plain-language result (for example by SMS): typically whether you appear to need a test that day, or not.
We are not a government agency, court, probation or parole department, monitoring company, attorney, or treatment provider. We do not provide legal advice.
2. Your responsibility (critical)
- You remain fully responsible for compliance with all court, probation, parole, and program requirements.
- The Service is provided on a best-effort basis. Calls can fail; audio can be ambiguous; carriers can delay SMS.
- If you do not receive a timely result, or anything looks wrong, call your official hotline yourself and follow your officer’s rules.
- We do not guarantee any outcome, any particular accuracy rate, or that use of the Service will prevent violations.
3. Eligibility and account
You must be able to form a binding contract and provide accurate configuration data (hotline number, identifiers, language, schedule). You are responsible for keeping that information up to date and for activity under your account.
4. SMS program
Opt-in (call to action): There is no public website phone form. End users opt in inside the MorningText mobile or web app during notification setup (and can manage SMS in settings). SMS is off by default. To enable SMS, you enter your mobile number and check a separate checkbox that is unchecked by default (not bundled with Terms acceptance). Checking that box is your express written consent to receive those messages. SMS is optional; you may use email instead. Consent is not a condition of creating an account if you decline SMS. - Description: Automated status notifications and system alerts related to your configured hotline checks.
- Frequency: Typically 1–2 messages per day based on your schedule. Additional messages may be sent if a check fails and you need to act. Frequency varies.
- Opt-out: Text STOP to the number that messaged you to unsubscribe. You may receive a final confirmation SMS.
- Help: Text HELP or email hello@morningtext.app.
- Rates: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- Non-sharing: We do not sell or share your mobile number with third parties for their marketing.
5. Fees and billing
New accounts include a 14-day free trial, measured from signup, with full access. After the trial, plans are $10 per month or $99 per year paid in full. Prices are also shown at purchase. Subscriptions renew automatically until you cancel. Payments are processed by Stripe; we never see or store your full card number.
How to cancel: in the app, open Settings → Subscription → Manage billing, or email aaron@morningtext.app. Cancellation takes effect at the end of the period you already paid for; service continues until then. Cancel during the trial and you will not be charged.
Replying STOP to a text message does not cancel a paid subscription. STOP only stops text messages (see Section 4). To stop billing, cancel as described above.
If a payment fails, we notify you and keep your service running for a 72-hour grace period while you update your card. Morning checks continue during the grace period.
6. Acceptable use
You agree not to misuse the Service, including by:
- Providing hotline credentials you are not authorized to use;
- Attempting to disrupt, reverse engineer, or overload the Service;
- Using the Service for any unlawful purpose.
7. Intellectual property
The Service, branding, and software are owned by MorningText LLC or its licensors. You receive a limited, non-exclusive right to use the Service as offered.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MORNINGTEXT AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, OR FOR ANY DAMAGES ARISING FROM MISSED TESTS, TECHNICAL VIOLATIONS, INCARCERATION, EMPLOYMENT IMPACT, OR RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR $50 IF YOU HAVE NOT PAID).
10. Indemnity
You agree to defend and indemnify MorningText LLC and its operators against claims arising from your use of the Service, your configuration data, or your violation of these Terms, except to the extent caused by our willful misconduct.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service.
12. Governing law
These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law rules. Venue for disputes will be in state or federal courts located in Colorado, unless applicable law requires otherwise.
13. Changes
We may update these Terms by posting a new version on this page with a new effective date. Material changes may also be communicated by email or in-product notice when the Service is live.
